RESOLUTION FOR THE UTAH LEGISLATURE TO SUNSET OR REPEAL SB-102 from 2021

WHEREAS, Article II of our U.S. Constitution specifies that only “Natural Born” citizens are eligible to the office of the President; and,
WHEREAS, Article IV of the Utah State Constitution restricts voting rights to only U.S. citizens; and,
WHEREAS, Article VIII of the Utah Constitution requires that judges be citizens of the U.S.; and,
WHEREAS, Confidence in law enforcement to uphold our shared values and rights as citizens is essential to public trust in law enforcement and government; and,
WHEREAS, Only a very few countries and States allow non-citizens to have police powers over their fellow citizens. Resident aliens would still be allowed to pursue all other employment they are eligible for; and,
WHEREAS, By this resolution, the Utah Republican Party declares it supports that only US Citizens should have police powers over Utah citizens; and
WHEREAS, SB-102 was sponsored by a Democrat Senator, Karen Mayne, and not called for by any grassroots body of Republicans in Utah; and,
WHEREAS, whatever benefit was hoped for by allowing non-citizens to have police powers over U.S. and Utah citizens has not materialized but the risk of exploitation remains; and,
WHEREAS, Cartels^, terrorist groups, or religious extremists could exploit this law allowing non-citizen police with no limit on what portion of Utah police could be foreigners. A cap of ~10% total foreign police to reduce risks would have been much more reasonable, and,
WHEREAS, The National Police Association (NPA), has called for and supports a Federal ban on States allowing aliens to be police officers in the US* via the Citizens Only Police Act, or COP Act of 2025 (H.R. 4783) and we believe those governed by this do not consent to this concept;
THEREFORE, BE IT RESOLVED, The Utah Republican Party calls upon our Legislature to sunset or repeal the provisions enacted by the 2021 session’s SB-102 in Utah Code Title 53, Chapter 6, Part 2, Section 203** allowing non-US citizens to have police powers over Utahns.
Upon passage our Utah Republican Party Chair shall ensure a copy of this resolution is posted on our website for not less than 2 years (or when the law is repealed if sooner) and emailed to GOP members of the Utah Legislature and elected members of the Executive Branch.
